Our firm’s Planning and Construction Department recently achieved another notable success before the District Planning and Building Appeals Committee for the Tel Aviv District, in which a decision by the Bnei Brak Local Planning and Building Committee was once again overturned.
The matter concerns a request for a permit for changes submitted by a well-known developer in the city, who sought to retroactively legalize illegal construction carried out in setback areas as part of a new residential project in the city.
Our firm, with means of attorneys Yacov Cohen and Orly Vidan from our Planning and Construction Department, filed an appeal against the Bnei Brak Local Committee’s decision to approve the permit, despite numerous flaws in the decision and the fact that part of the construction constitutes a significant deviation, which the committee does not have the authority to approve.
The Appeals Committee accepted the appeal, ordered the cancellation of the Local Committee’s decision, and determined that the extensive construction in the setback areas cannot remain and must be demolished as soon as possible, considering the severe harm caused to the surrounding property owners.
