In a recent unique decision, the Tel Aviv District Court (Hon. Judge Michal Agmon Gonen) determined that a public transport company does not need to indemnify passengers due to strikes taken by its employees.
The court discussed an application to approve a class action filed against Kavim, claiming it should compensate passengers holding day passes and monthly passes, for ‘failure of consideration’ for the days on which drivers were striking, and caused injury to bus activity. The court rejected the application for approval and ruled 20,000 NIS expenses in favour of Kavim.
Kavim was represented by lawyers Yaron Reiter and Yael Apple-Shoham.
